Notary Service
Any official documentation for use outside England and Wales may need the assistance of a qualified Notary. With less than 900 notaries in this country, its good to know Vizards Wyeth can help you.
Typical Notarial Tasks are:
Witnessing Powers of Attorney for use overseas. Used when clients are buying or selling land abroad and cannot be present for the completion meeting.
Dealing with the purchase or sale of land and property abroad, including witnessing mortgages, for countries where personal attendance at completion meeting is not required, for example, Florida.
Provide documents to deal with the administration of the estate of people who are abroad, or owning a property abroad.
Protesting a foreign Bill of Exchange, this has to be done within 24 hours of dishonour and a notary needs to attend the place of payment, usually a bank.
Authenticate personal documents and information for: immigration or emigration purposes, or to apply to marry or to work abroad
Administering oaths and declarations for use in foreign jurisdictions e.g. affidavit for divorce abroad.
Preparing and witnessing a wide variety of documents and transactions for use overseas where the foreign country require authentication by a notary
Preparing and witnessing a ships protest. This is used where a ship incurs damage to the vessel or freight at sea and the Master of the vessel needs to record the incident as soon as he lands ashore.
Notaries will advise upon other legalisation requirements, provide authentication and a secure record for almost any sort of transaction, document or event.
Availability
Vizards Wyeths notary service is available by appointment throughout London and Kent during normal working hours, although we can travel to you or arrange to meet outside normal working hours upon request.
What is the process?
A Notary must act independently and ensure that the transaction is a genuine one. This involves checking the status of persons who are to be party to the transaction and that they understand the transaction and enter it freely. Our Notary will require suitable identification such as a passport and a Council tax or utility bill, to confirm your address, plus any relevant papers or documents relating to the transaction. As some transactions can be complex it is advisable to send or email a copy of your documents to the Notary prior to your meeting to check for any additional requirements.
For Limited Companies, the identification procedure requires a copy of the Memorandum and Articles of Association and a copy of the Certificate of Incorporation. Where a Director is signing, it will be necessary for that Director to produce evidence that they have authority to act on behalf of the company e.g. a minute of a board resolution.
The Notary will need to ensure the document is clearly understood, even if it is not in English.
Fees
Our normal approach is to provide specific quotes in advance for each transaction. As a guide Notary Services fees are normally £180 per hour, with a minimum fee of £80. Usually the transaction can be brief and the minimum charge of £80 is sufficient to cover the costs. This will include examining documentation, advising upon what is required in relation to other legalisation formalities, completing the Register/Protocol and identifying the client. Notary fees are not chargeable to VAT.
There may also be fees to pay to third parties such as the Foreign and Commonwealth Office, an Embassy or Interpreter/Translation Costs. Most countries accept only one certificate from the Foreign Office called an Apostille and this currently costs £27.00 per document.
